What is Dissolution of Marriage?
A dissolution of marriage is a legal action that terminates your marital status through a judgment issued by a court. In Yuba County and Sutter County, dissolution proceedings often involve complex issues including:
- Child custody and visitation rights
- Child support obligations
- Spousal support (alimony)
- Property division and characterization
- Payment of fees and court costs
California Requirements for Divorce
Residency Requirements
To file for dissolution of marriage in California, you must meet specific residency requirements:
- At least one party must have lived in California for six months
- At least one party must have lived in the county (Yuba, Sutter, etc.) where the action is filed for at least three months
No-Fault Divorce State
California is a no-fault dissolution state. This means the reason for the dissolution does not matter for terminating your marital status—only that there are irreconcilable differences between the spouses.
The Divorce Process
A dissolution is initiated by filing a Petition for Dissolution and Summons. These documents must generally be personally served on the other spouse. The earliest date your marital status can be dissolved is six months after the earlier of:
- The date of service on the other party, or
- The date a Response is filed
This six-month waiting period can only be waived if all required documents are properly filed with the court.
